FLSA Salary Threshold Injunction - Update on Next Steps

In July 2016, the Department of Labor finalized regulations for the Fair Labor Standards Act (FLSA) that raised the minimum salary threshold from $455 per week (23,660 annually) to $913 per week ($47,476 annually) in order to meet the criteria to be paid salaried (exempt).  Employees paid less than $47,476 per year had to be changed from salaried (exempt) to hourly (non-exempt) no later than December 1, 2016.  Since PSU is in the middle of implementing the new GUS HR system, the decision was made to change affected employees from salaried to hourly effective with pay period beginning October 9, 2016.

Last week, a Federal District Court granted a nationwide preliminary injunction preventing the FLSA’s proposed new rule that raised the salary threshold to $47,476 annually from taking effect on December 1, 2016.  PSU will take the following steps effective with pay period starting December 4, 2016:

  1. Employees who were changed from salaried to hourly effective October 9, 2016 because they did not meet the $47,476 per year salary threshold will be returned to salaried effective December 4, 2016. Employees who earned overtime or compensatory time from October 9ththrough December 3rd will retain the overtime pay and compensatory time balance.  Compensatory time balances will be subject to the limits for salaried (exempt) employees.
  1. Employees hired into positions and paid hourly (non-exempt) due to the proposed salary threshold will also be changed to salaried (exempt) if the duties of the position meet one of the FLSA exemption tests.
  1. Employees paid at or above the proposed $47,476 per year salary threshold not be affected.

Information will be sent to each affected employee and their supervisor later this week.

There are 2 different grids – one for Plan A Health Plan Members and the other for Plan C Health Plan Members. We will also be hosting webinars in December to further discuss the new program as well as demonstrate the new HealthQuest portal. Remember the new HealthQuest program year will run calendar year and participants need to earn 40 credits for the premium reduction in 2018.

Compensatory Time Bank Balances - GUS HR Information

We have finalized the policy on compensatory time bank balances effective with go-live.  Here is a link to the HRS web page with the new policy:  This week (week of July 18, 2016), we are sending letters to all supervisors with employees who currently have a balance over the new compensatory time bank balance maximum.  The employee and division head are also getting the letter.  Keep in mind that we are providing for an 18-month transition period to give supervisors and employees who are over the maximums ample time to work out a plan to be in compliance by May 2018.

Working After Retirement Rules for KPERS Retirees - Effective July 1, 2016

Any PSU employee who is receiving a KPERS retirement benefit should review the new Working After Retirement rules effective July 1, 2016 found on the KPERS web site:  We are still learning these rules and do not have any information other than what is found on the KPERS web site.  We will share more as it becomes available.  Employees should contact KPERS for more information at 1-888-275-5737.
